PLATFORM TERMS OF SERVICE – TRAVELLERS
We, Planet Youth Pty Ltd [“Planet Youth”] provide an online platform (the “Platform”) to connect you (the “Traveller”) with operators (the “Operators”) of tours and other travel related services (the “Travel Services”).
The Platform is accessible at www.planetyouth.com . By using the Platform, you agree to be bound by these Terms, which incorporate our Privacy Policy. If you do not agree to these Terms, you must cease to access and otherwise use the Platform and the services ancillary to it.
Planet Youth reserves the right to modify the Platform and these Terms without notice. Any modifications will become effective once published. By continuing to use the Platform, you are deemed to have agreed to the modified Terms. If you do not accept the modified Terms, your only remedy is to cease using the Platform.
OPERATORS ARE RESPONSIBLE FOR DELIVERY
1. Planet Youth does not principally supply any Travel Services. Planet Youth acts as an agent for Operators to facilitate the promotion and your purchase of Travel Services through the Platform.
2. Planet Youth’s responsibilities are limited to arranging for Travellers to enter contracts for the supply of Travel Service with Operators through the Platform. Planet Youth is not party to any contract between a Traveller and an Operator.
3. Planet Youth may receive financial benefits (including commissions) and non financial benefits from Operators when the sale of their Travel Services to you is facilitated through the Platform.
4. Planet Youth has no control over the Operator and does not guarantee performance by any Operator. Planet Youth does not warrant the standard or fitness for a particular purpose of any Travel Services or a particular Operator and to the fullest extent disclaims any warranties of this nature.
5. The Operator is responsible to you for the delivery of Travel Services subject to their own booking conditions (“Operator Booking Conditions”). These may set out refund and cancellation terms and may also limit the Operator’s liability to you. It is your responsibility to ensure you are aware of the Operator Booking Conditions.
6. Planet Youth is not liable for any acts, omissions, failures or delays on the part of any Operator (or any of their employees, agents, contractors or suppliers). Any claims you may have in connection with the performance of Travel Services (including in relation to refunds) must be made directly against the Operator (except to the extent the claim arises due to our fault).
ACCURACY OF INFORMATION
7. Any information relating to Travel Services or an Operator has been provided by the Operator or an independent third party. Planet Youth requires Operators to provide accurate information regarding Travel Services and themselves, but is not responsible for this information. Planet Youth makes no warranty regarding the completeness, accuracy or standard of this information. You should make your own enquiries to verify information related to Travel Services or an Operator before making a booking through the Platform.
8. Planet Youth does not endorse or recommend any particular Operator or Travel Services.
9. Any reviews and ratings of Travel Services and Operators have been drawn from the Operator’s own website or third party websites which list the Operator’s Travel Services. These reviews and ratings should be used as a guide only and do not guarantee the performance of any Travel Services or Operators. Planet Youth has not verified the reviews or ratings and you rely on them at your own risk.
PAYMENTS
10. All payments for Travel Services must be made direct to the Operator as may be facilitated through the Platform.
11. You acknowledge that Planet Youth is not the merchant of record for the sale and purchase of Travel Services.
12. Payments must be made to the Operator with the timeframes specified by the Operator.
AMENDMENTS & CANCELLATIONS
13. You must requests amendments to booked Travel Services directly with the Operator. Please note that the ability to make amendments (and associated terms and fees) is subject to agreement by the Operator in accordance with the Operator Booking Conditions.
14. You must cancel booked Travel Services directly with the Operator. The Operator may charge cancellation fees in accordance with the Operator Booking Conditions. Often payments will be non-refundable, and any further cancellation fee will generally be dependent on the amount of notice of cancellation you give. Cancellation fees can be one hundred percent of the booking value.
15. You acknowledge that Planet Youth has no control over any Operator and does not warrant or guarantee that amendments will be possible (or on any particular terms) or that Operators will make any refunds as they may be required to do so under the Operator Booking Conditions.
UNAVOIDABLE & EXTRAORDINARY CIRCUMSTANCES
16. “Unavoidable and Extraordinary Circumstances” means circumstances pursuant to which your Travel Services cannot proceed due to flood, earthquake, war or civil strife, acts of terrorism, hurricane, cyclone, industrial disturbance, strike, fire, lock out, epidemic, pandemic, failure or delays of scheduled transportation, or any law, order, decree, rule or regulation of any government authority (including quarantine requirements or government travel advisories), or for any other reason beyond the Operator’s control.
17. In the event of Extraordinary and Unavoidable Circumstances, the Operator may cancel or modify your Travel Services in accordance with the Operator Booking Conditions. Your rights to a credit or refund may be limited under the Operator Booking Conditions. We make no guarantee and expressly disclaim any warranty that we will be able to obtain a refund or credit from an Operator.
18. Please note that any credit or refund issued by the Operator may be partial only and may be subject to specific conditions. We have no control over these conditions.
REFUNDS
19. If you are due a refund for any cancelled Travel Service, then you must pursue such refund from the Operator directly.
20. While Operators may be obliged under the Operator Booking Conditions or at law to provide a refund, we do not represent or warrant that Operators will comply with their obligations and take no responsibility for their failures.
DISPUTES WITH OPERATORS
21. Planet Youth may, but is not obliged, to assist Travellers to resolve disputes with Operators. If Planet Youth does provide any assistance, this does not make Planet Youth a party to the dispute. Planet Youth provides assistance in good-faith and Planet Youth accepts no liability for the provision of any assistance (whether or not the assistance is deficient). If you request Planet Youth to offer assistance or you otherwise accept Planet Youth’s assistance, then you accept it strictly on this basis.
TRAVEL ADVICE
22. We strongly suggest that you contact the Department of Foreign Affairs and Trade (“DFAT”) or visit the Smart Traveller website for the most up to date travel advisories for the destinations that you wish to travel to. You can register your travel plans with DFAT so that you can be easily contacted in an emergency.
23. If book Travel Services in or to a destination that is subject to a DFAT travel advisory we accept no liability for your choice and the risks associated with travelling to that destination.
PASSPORTS, VISAS & VACCINATIONS
24. Passport and visa requirements are your responsibility. It is a requirement that you hold a valid passport to depart Australia, and most countries require passports to have at least 6 months validity. This means your passport should be valid for at least 6 months from your scheduled return to Australia.
25. It is your responsibility to obtain vaccinations and preventative medicines as may be required for the duration of your travel. It is your responsibility to ensure that you are in possession of the necessary documentation to comply with the laws and regulations of the destinations to be visited.
COVID-19
26. You acknowledge that you are choosing to travel at a time when you may become exposed to Covid-19. You agree that you assume responsibility for risks to your health associated with travelling in the current environment.
27. You should familiarise yourself with any vaccination obligations and obligations to have a negative Covid-19 PCR test within a certain period prior to travel and any obligations to quarantine either in destination or on return to Australia, or domestically. It is your responsibility to satisfy these requirements and associated costs.
28. Please note that some airlines and other Operators have implemented mandatory requirements in relation to vaccines and mask-wearing. It is your responsibility to familiarise yourself with these requirements and to comply with them.
OUR LIABILITY
29. Australian Consumer Law and corresponding legislation in State jurisdictions in certain circumstances imply mandatory conditions and warranties into consumer contracts (“Consumer Warranties”). These Terms do not exclude or limit the application of the Consumer Warranties. Other than the Consumer Warranties, we disclaim all warranties.
30. To the fullest extent permitted by law:
(a) we do not accept any liability under these Terms, in tort (including negligence) or at law for any injury, loss (including indirect losses), delay or additional expenses caused directly or indirectly by the actions or omissions of a third party over whom we have no direct control (including a Operator); and
(b) our maximum liability to you under these Terms, in tort (including negligence) or at law is limited to resupplying services to you or paying to have them resupplied.
LINKS
31. The Platform may contain links to third-party websites. You acknowledge and agree that Planet Youth is not responsible or liable for the content on, or services offered through, those websites. By linking to a third party website, Planet Youth is not endorsing the content or products offered on such websites. You assume all risk for your use of these websites and any products offered on them.
TRAVELLER CONTENT
32. Planet Youth may permit you to publish reviews of Travel Services (and the associated Operator) you have purchased through the Platform (“Traveller Reviews”). You grant Planet Youth with a royalty-free, worldwide, irrevocable, perpetual, non-exclusive, transferrable, licence to use, publish, licence, sell, transfer, broadcast (via any means) and otherwise exploit your Traveller Reviews. You agree to waive any moral rights you may have in any Traveller Reviews you make.
33. You warrant to Planet Youth that (a) you are the sole owner of the Traveller Review or have all rights to the Traveller Review; (b) any Traveller Review will not infringe the rights of any third party; and (c) any Traveller Review will be accurate, will not misleading and will not be vexatious. You agree to indemnify and hold us harmless from and against (meaning that you are totally responsible for) all claims made against us if any of the foregoing is or becomes untrue.
GENERAL
34. The contract between Planet Youth Pty Ltd trading as Planet Youth and you is governed by the laws of the State of Victoria. Any disputes shall be dealt with by a court with the appropriate jurisdiction in Victoria.
35. If any provision of these Booking Conditions is found to be unenforceable, then to the extent possible it will be severed without affecting the remaining provisions.
36. We may assign or transfer rights under these Terms without restriction and without notice. You must not assign your rights under these Terms without our prior written approval.
37. Any personal information you provide to us will be collected, stored, used, protected and shared in accordance with Australian Privacy Principles, and our Privacy Policy, which is published here www.planetyouth.com
